Welcome to myCircles! These Terms of Service ("Terms") govern your access to and use of our application, services, and website (collectively, the "Service"). Please read these Terms carefully before using the Service. By creating an account or using the Service, you agree to be bound by these Terms.

1. Your Account

To use myCircles, you must register for an account. You agree to provide accurate and complete information and to keep this information up to date. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

2. User Conduct and Responsibilities

You are solely responsible for your conduct and any data, text, files, information, images, polls, links, and other content or materials (collectively, "User Content") that you submit, post, or display on or via the Service. You agree not to:

• Post content that is unlawful, harmful, defamatory, obscene, infringing, harassing, or hateful.
• Violate any applicable laws in your jurisdiction, including but not limited to copyright and intellectual property laws.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Use the Service for any unauthorized purpose, including spamming or distributing malware.

3. Content Ownership and License

Your Content

You retain all ownership rights to the User Content you create and share on the Service.

License You Grant to Us

By posting User Content to the Service, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, reproduce, modify, and distribute your User Content on and through the Service. This license is solely for the purpose of operating, developing, providing, and improving the Service. This license ends when you delete your User Content or your account.

4. Moderation and Enforcement

myCircles is designed for private, trusted groups ("Circles"). Moderation is handled at multiple levels:

• Circle-Level Moderation: Circle administrators and moderators have the authority to manage members and remove content within their specific Circle.
• Service-Level Moderation: We reserve the right, but are not obligated, to remove any User Content and to suspend or terminate user accounts that we determine, in our sole discretion, violate these Terms.

5. Third-Party Services

Our Service integrates with certain third-party services to provide enhanced features. Your use of these features is subject to the terms and policies of those third parties.

• Image Uploads (Cloudinary): When you upload an image, it is processed and stored by Cloudinary. By uploading images, you agree to Cloudinary's Terms of Service.
• AI-Powered Poll Generation (OpenAI): When you use the feature to generate a poll from text, the text you provide is sent to OpenAI for processing. This is subject to OpenAI's Terms of Use.
• YouTube Playlists: The Service allows for the embedding and sharing of YouTube videos. Your interaction with YouTube content is governed by YouTube's Terms of Service.

6. Termination

You can terminate your account at any time. We may also terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, MYCIRCLES DISCLAIMS ALL WARRANTIES.

IN NO EVENT SHALL MYCIRCLES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make changes that are material, we will provide you with reasonable notice, such as by posting the revised Terms on the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

9. Governing Law

These Terms shall be governed by the laws of the State of New York, United States, without regard to its conflict of law provisions.
